Professor Tim McFarlin’s article, “Infringing Uses, Not Works,” which discusses the implications of the U.S. Supreme Court’s copyright ruling in Andy Warhol Foundation v. Goldsmith, was recently reviewed in Jotwell, the Journal of Things We Like (Lots), by NYU Professor Christopher J. Sprigman. Per its mission statement, Jotwell is “a space where legal academics can go to identify, celebrate, and discuss the best new scholarship relevant to the law.” There, Sprigman describes McFarlin’s article as “a valuable early entry in what will be a lengthy period in which the implications of the Warhol Court’s two big holdings are digested (or not) by the law.” 

“Professor Sprigman’s work, particularly in copyright, has long been an inspiration,” McFarlin said, “so to read his review is a thrill and an honor. It captures well the spirit of the piece, such as it is, and I hope ‘Infringing Uses, Not Works’ lives up to his praise by helping deepen our understanding of infringement, fair use, and remedies in copyright law.”
